1. Introduction
Welcome to Still Step ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Still Step mobile application (the "App") and related services (collectively, the "Services"). By downloading, accessing, or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
2. Acceptance of Terms
By creating an account or using Still Step, you represent and warrant that:
- You are at least 13 years of age (or the minimum age required in your jurisdiction)
- You have the legal capacity to enter into these Terms
- You will provide accurate, current, and complete information during registration
- You will maintain the security of your account credentials
- All information you provide is truthful and accurate
3. Medical Disclaimer
IMPORTANT: Still Step is NOT a substitute for professional medical advice, diagnosis, or treatment.
Our Services are designed to provide mental health and wellness tools, resources, and support. However:
- We do not provide medical or mental health professional services
- The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition
- Always seek the advice of qualified health professionals for any medical or mental health concerns
- Never disregard professional medical advice or delay seeking it because of information from our Services
- If you are experiencing a mental health emergency, please call emergency services or a crisis hotline immediately
4. User Accounts
To access certain features of the Services, you may need to create an account. You agree to:
- Provide accurate and complete registration information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate your account if we suspect any unauthorized use or security breach.
5. License and Use of Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
5.1 Permitted Use
You may use the Services for their intended purpose: to access mental health and wellness tools, track your mental health journey, and utilize resources provided within the App.
5.2 Prohibited Use
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to any part of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services for any commercial purpose without our written consent
- Interfere with or disrupt the Services or servers
- Collect or harvest any information from other users
- Impersonate any person or entity
- Use the Services in any way that could harm minors
6. User Content and Data
You retain ownership of any content you create, upload, or store through the Services ("User Content"). However, by using the Services, you grant us a limited license to use, store, and process your User Content solely for the purpose of providing and improving the Services.
6.1 Your Responsibilities
- You are solely responsible for your User Content
- You must have the right to share any content you upload
- You warrant that your content does not violate any laws or third-party rights
- You understand that we may remove or modify User Content that violates these Terms
6.2 Data Security
We take reasonable measures to protect your data. However, no method of transmission over the internet is 100% secure. Please see our Privacy Policy for more information about how we collect, use, and protect your data.
7. Subscription and Payment
Still Step may offer both free and paid subscription plans. If you purchase a subscription:
7.1 Billing
- Subscription fees are billed in advance on a recurring basis (monthly, yearly, etc.)
- You authorize us to charge your payment method for all fees
- Prices are subject to change with notice
- All fees are non-refundable except as required by law
7.2 Cancellation
- You may cancel your subscription at any time through your account settings or the App Store
- Cancellation takes effect at the end of your current billing period
- You will retain access to paid features until the end of the billing period
- No refunds will be provided for partial billing periods
7.3 Free Trials
If we offer a free trial, you must cancel before the trial period ends to avoid being charged. If you do not cancel, your payment method will be charged the subscription fee at the end of the trial period.
8. Intellectual Property
The Services, including all content, features, functionality, software, designs, text, graphics, logos, and other materials (excluding User Content) are owned by Still Step or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission. Unauthorized use may result in termination of your access and potential legal action.
9. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and protect your personal information. By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.
We are committed to maintaining the confidentiality and security of your mental health data in accordance with applicable privacy laws and regulations.
10. Third-Party Services and Links
The Services may contain links to third-party websites, apps, or services that are not owned or controlled by Still Step. We are not responsible for the content, privacy policies, or practices of any third-party services.
Your use of third-party services is at your own risk, and you should review their terms and privacy policies before using them.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Services will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that defects will be corrected
We do not warrant that the Services will meet your requirements or that the results obtained from using the Services will be accurate or reliable.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STILL STEP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, use, or goodwill
- Service interruption or system failures
- Cost of substitute services
- Personal injury or property damage
- Any damages arising from your use or inability to use the Services
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Still Step and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your User Content
- Any breach of your representations and warranties
14. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
- Upon your request
Upon termination, your right to use the Services will immediately cease. We may also delete your account and User Content, though we may retain certain information as required by law or for legitimate business purposes.
You may terminate your account at any time by contacting us or using the account deletion feature in the App.
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute with Still Step, please contact us first to attempt to resolve it informally. We are committed to working with you to find a fair resolution.
15.2 Arbitration
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
15.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and Still Step individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Still Step operates, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.
17. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you through the App or via email (if applicable)
- Provide you with a reasonable opportunity to review the changes
Your continued use of the Services after changes take effect constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and Still Step regarding the Services and supersede any prior agreements or understandings.
